Marinho Pinto to testify

Many thanks to Pedro for the translation of the news coming from Portugal about the pending libel trial over Goncalo’s book.

Correio da Manhã newspaper is reporting the following:

Marinho is witness

The chairman of the lawyer´s association Marinho Pinto will testify for the couple McCann against gonçalo amaral, in the civil process that Madeleine´s parents moved against the former PJ coordinator of the directorate of PJ in Portimao, Correio da Manhã has learned.

Marinho Pinto offered himself to testify in person, against the former coordinator at the trial that was scheduled to start next week but was postponed by the judge who granted the request of the McCanns to be heard several English witnesses through videoconference.

Now the burning question is, who are these witnesses?  Could they be ..

  • Reporters from Leveson Inquiry (remember the Diary and source of leaks referred to under sworn testimony)
  • Martin Grime
  • Scotland Yard
  • Lee Rainbow
  • Dog experts

Interesting times ahead me thinks and thanks Hael for coming up with a list of potential witnesses….

And we all can remember what he said (with thanks to Sal on Stop the Myths for finding this gem) about the investigation during a Radio 4 discussion:

Right now we’ve got three arguidos, including the missing girls parents, and we need to know why. Judicial secrecy is there to protect the effectiveness of the investigation, but it shouldn’t be protecting the negligence of incompetence of the investigators. Here there are strong reasons to fear that judicial secrecy is being used to conceal the fact that the police have gone down a blind alley and have no way out.

No wonder Cabrita threw in the towel… if he saw the witness list, it makes you wonder, if he decided to advice a certain book writer to settle out of Court as it could probably be the cheapest.  Whether we will hear the full truth as to why there was a split between Cabrita and Goncalo Amaral, I don’t know, but it does make you wonder why a lawyer would renounce his client.

  1. Considering Freitas wasn’t allowed to testify, I doubt Grime, Rainbow etc would be commenting re. an on going investigation.

Possibly participants in the Leveson inquiry.

    • Module 2 is about the press and the police. Could de Freitas be a CP?

Core Participants, January 2012 News International; The Metropolitan Police; The Metropolitan Police Authority; Victims; Northern and Shell Network Ltd; Guardian News and Media Ltd; Associated Newspapers Ltd; Trinity Mirror; Telegraph Media Group; and the National Union of Journalists.http://www.levesoninquiry.org.uk/about/core-participants/

  2. Normally I would say yes, but Freitas was being asked to testify as a witness for Goncalo Amaral.

Grime is now a civilian and the hearing said the files could be used, so all Isabel Duarte has to do is to prove to the Court that unless the dogs alerts are backed up by forensics they are only indicators and not actual evidence.  And she only has to get him to say that a cadaver dog will alert to decomposing bodily fluids from a live person..

As for Rainbow, well didn’t Cabrita read out his report in Lisbon during the book ban appeal? Which brings into question how did Cabrita get that because it is not in the files, and Goncalo Amaral was not a Police Office at the time and should not have been in possession of any case file papers, even if they were photocopies.  Surely Isabel Duarte will contest it’s use or ask for clarification, who better to ask.

  3. Kate McCann

The UK police would argue that their hands were
tied: The Pt might have perceived any ‘interference’ as an attempt to undermine
their primacy in the investigation, which which would have had implications not
only for the current inquiry but also for any future international cooperation.
We were aware of the frustrating constraints of this delicate relationship, but
to us, it just felt like a betrayal.

The most difficult thing for us has been that we
know the British police considered aspects of the investigation to be
substandard and we honestly don’t think they believed we were involved in
Madeleine’s disappearance. Comments made to us privately by several officers
(including the most senior ones0 confirmed this, but did nothing to prevent us
from feeling we’d been hung out to dry when radio silence was maintained in
    public.

It is exasperating, too, that while we know the UK
police are well aware of the selective leaks to the media, and and what they
seem designed to achieve, they still insist that have a cooperative relationship
with the PJ. These leaks have included confidential statements taken by officers
in Britain and supplied to the Portuguese police – and in some cases. the
breaching of that confidence has caused immense damage to people other than
    ourselves.

It all makes this cooperation look very one sided.
By declining to speak out about this kind of behaviour. which wouldn’t be
tolerated in our country, they are conveying the impression of a tacit
acceptance of it, even agreement with it.

  5. Why did Isabel Duarte state upon leaving the last Lisbon hearing with her clients (the McCanns) that they had just seen new evidence and photographs , asked if they were of Madeleine?
    “Yes! she replied some shocking”!
“Why shocking”, she was asked and replied “Never mind”. with a brush of her hand.
If shocking photographs of Madeleine are reported why are they not released to the public or are the public being strung along in limbo in a  case where the parents have pleaded for help to find Madeleine, and also continue to take public money donated to the Madeleine fund on the assumption Madeleine is and still can be found alive and in good health?

    • Sandra
Felgueiras: …the evidence you saw are sufficient to re-open the
      process?

Isabel Duarte: erm…What I’ve seen was various relevant
information, photos, possible locations, license plates…

Sandra Felgueiras: That your clients didn’t
      yet identify?

Isabel Duarte: My clients are knowing it now. My clients
knew about this now. I have the documentation with me to deliver to
      them.

Sandra Felgueiras: And the photos that you’ve seen, did they seem
      to be of Madeleine?

Isabel Duarte: There are photos who are SIMILAR  to
the girl, erm, even shocking, and there are others…

      Sandra Felgueiras:
      Shocking, why?

      Isabel Duarte: It doesn’t matter.

      Unknown Male
Portuguese Journalist 2: You said that Inspector Ricardo Paiva lied, are you
planning to act criminally against him, as
      you did with…?

Sandra Felgueiras: [in simultaneous with the above
      reporter] The situation is shocking?

      Isabel Duarte: [in simultaneous with
the above reporter] The situation where the girl is in, yes.

      Isabel
Duarte: No, in relation to Inspector Ricardo Paiva, the importance that I give
to him is the importance of knowing if he should be heading or not the
      investigation to this process, because…

      Unknown Male Portuguese
Journalist 3: So, you are definitely placing him in question?

      Isabel
Duarte: I am not… What I said should not be interpreted beyond my
      words.

Unknown Male Portuguese Journalist 1: Doctor [doctor is applied to
anyone who has an University degree], so
let’s try to speak in a clear way. Before what you said…

      Isabel Duarte:
My words are clear, for you and for other persons.

      Cut to: McCanns
      getting inside the car.

      • Thank you Samantha for that… so Isabel Duarte said SIMILAR to Madeleine…

My how words can be twisted to mean something else.

    • I can’t understand your logic of wanting shocking photos of Madeleine released to the public.  If such photographs are in the possession of the authorities and Isabel Duarte has seen them, surely the goal would be to find Madeleine and reunite her with her parents.

What release photos that are shocking so the ghouls could salivate over them.. no way, those images should be used by the Police to find her location.

And if this was my child I would still want the publics help and so would you if this was your child.

    • Surely you are not insinuating that Paiva ignored this shocking new evidence – are you?

  6. It seems Flores is now steeping down

Moita Flores: Half time due to illness

The president of the municipality of Santarém requested an exclusive end of the post for health reasons and will now receive half the salary.

    http://www.cmjornal.xl.pt/detalhe/noticias/ultima-hora/moita-flores-meio-tempo-por-doenca

Yes there was a scandal only recently about Flores being a Mason

    http://semanal.omirante.pt/index.asp?idEdicao=530&id=80216&idSeccao=8810&Action=noticia

With the controversy surrounding the Masonry installed and links this to political power and business, the Mayor of Santarém, Francisco Moita Flores (PSD), decided to take a strong voice in the RTP information that belongs to the Masons for nearly 30 years. Nothing that does not already know officially, but as soon as the register of interests of Moita is more complete: Sporting, Catholic, Mason and aficionado, here is your ID.

  7. Hi Bren.
Don’t know what clip you are looking at but in relation to the vidio of Isabel Duarte’s comments outside the last Lisbon hearing , below are the english subtitles I’ve just got again.
Won’t go all the way throught the Media and Isabels statements but pick up with.
Isabel stating what info she just saw.
    Isabel—Photo,Localisations,License Plates.
Isabel–My clients are learning about this,
Isabel–I have the documents for them
Media—THE PHOTOS YOU SAW WERE OF MADELEINES TO YOU?
    Isabel–ON SOME PHOTOS , YES.
    Isabel–SOME EVEN SHOCKING
    Media– WHY SHOCKING?
    Isabel–DOES’NT MATTER.
Are there maybe two videos because I got this one right here with me!

  8. Well the translation that Samantha quoted was by Joana Morais

    http://themaddiecasefiles.com/topic6421.html

  9. Sorry, but the translation (English subtitles) were directly on screen when Isabel was talking, like I said I have the video at my fingertips.
Don’t know if the on-line media are allowed to change what the interviewee is saying when they are talking, I would not have thought so.
As for shocking photographs of Maddy being shown to the public, you are right, it would SHOCKING!
If proof of Madeleine’s ordeal or even her death brings everyone peace and closeure including Madeleine, then so be it!
People were begged to give money to find Madeleine, they must know what was in those shocking photographs of her were and if she is dead or alive?
Lastly, Can you please tell me,what is the difference of the sick picture Kate described in her book about Madeline genitals being torn apart.
I found her thoughts sickening with no need for such gruesome details.
By the way I am neutral, I just want the truth about Madeleine, if the McCanns have evidence/ photographs then inform the public who are still sending money to find Madeleine alive and well.

    • I have removed some of your comments, Kate describes the torment and horrid thoughts, I really don’t think there is need for any person to have such pictures.

If the McCanns or any one has evidence IT DOES NOT NEED TO BE PUT INTO THE PUBLIC DOMAIN, it needs to be sent to the Police so that they can track whoever has her.

Why would you want such horrid pictures put into the public domain, Joseim52?  Just out of curiosity, are you a parent, I don’t think any one would want to see pictures like that,

  10. If there are such pictures I am sure the police have them by now and they will be used in evidence as part of the case to prove Madeleine’s fate, hence same as what happened in the  Jonbennet case, nothing left unrevealed.
Time WILL reveal all what happened to little Madeleine, I can assure you!

  11. Pardon! What does F.T mean Sam?

  12. Fanks and Ta

  13. Your welcome Sam!
